Marina Tokmakova, head of the real estate practice at Duvernoix Legal, commented on Kirill Korshunov's article "How to defend an unauthorized construction". The expert focused her attention on such a method of judicial protection, which can be applied by a public legal body, as recognition of the right to be absent.

In her opinion, the termination of registration of the right to real estate object on the basis of a claim for recognition of the right to be absent is impossible, but there may be exceptions, namely, when the rights are disputed not to the entire real estate object, but to a part thereof belonging to the defendant.
